  • terms and conditions

    • Use of the Card and the Card Services is conditional upon the acceptance of the terms and conditions defined herein. Any contravention of the terms and conditions defined herein or the laws of the State of Qatar shall be construed as a material breach of this Agreement.
    • The Bank shall have the right, without reference to the applicant, to examine and review the credit standing of the applicant at any time the Bank deems fit. The Bank is hereby authorized to disclose any information it may collect including, without limitation, the address, salary, professional, financial or any other information to any other party pursuant to the credit examination/review.
    • The Bank reserves the right to require additional documentation, information or evidence and the approval, use, refusal of a Card shall be at the sole discretion of the Bank.
  • definitions

    Unless otherwise permitted by the context, the following words shall bear the meaning given to them.

    • "Bank" means Al Khalij Commercial Bank QSC and its successors and assigns.
    • "Billed Amount" means the amount billed on the Statement of Account pertaining to all the Card Transactions within one Billing Cycle.
    • "Billing Cycles" means the time period between the dates of issuing two consecutive Statements of Account.
    • "Balance Transfer" means a payment (subject to a minimum sum of QR 250), made at the Principal Cardholder's instruction, to another financial institution in the State of Qatar. Balance transfers are subject both to the Bank's prior approval and to any interest, fees, charges, costs and expenses that the Bank may, from time to time stipulate.
    • "Card" means the Visa/MasterCard Credit Card issued by the Bank and includes any corresponding Supplementary Cards issued.
    • "Cardholder" means the person authorised by the Bank to use the Card. All references to the Cardholder shall include, where applicable, the Supplementary Cardholder.
    • Card Account means the account maintained in respect of the Card.
    • Card Services means any and all of the facilities and services provided by the Bank or any other party in respect of the Card and shall include all credit, banking and electronic facilities.
    • Card Transactions means all the transactions made using the Card and shall include without limitation the any transactions entered into by the Cardholder, Cash Advance and Money Transfer.
    • Cash Advance means the cash, whether in local or foreign currency, provided by the Bank to the Cardholder against the Card Account.
    • Cash Advance Fee means the fee charged when the Cash Advance is provided to the Cardholder.
    • Cardholder's Account means the current or deposit account maintained by the Cardholder.
    • Credit Limit means the maximum line of credit extended to the Card Account
    • Foreign Exchange means, the exchanging of Qatari Riyals for any other currencies, whether at the Cardholder’s specific request or as a result or making a Card Transaction where the goods or services were offered in a currency other than Qatari Riyals.
    • Grace Period means the time period between the issuance of the Statement of Account and the Payment Due Date during which no Finance Charge may be incurred on the new purchase balances.
    • Interest means the interest charged by the Bank, as amended from time to time.
    • Late Payment Fee means the fee charged where any payments due are received and posted to the Card Account after the Payment Due Date or where the payment received and posted is less than the Minimum Payment.
    • Money Transfer means a transfer of funds from the Card Account to any personal account held by the Principal Cardholder at another financial institution other than into another credit card or loan account or any other transaction the Cardholder uses to pay other bills.
    • Minimum Payment means the minimum payment amount, specified in the Statement of Account, required to be paid by the Principal Cardholder on or before the Payment Due Date.
    • Outstanding Balance means any monies, costs, expenses, charges, interest and penalties that are due from the Cardholder in respect of a Principal and Supplementary Card, to the Bank including but not limited to Cash Advances, Card Transactions and Past Due Amounts.
    • Over Limit Fees means the fee charged to the Card Account where the Cardholder exceeds the Credit Limit in one Billing Cycle.
    • Past Due Amount means the Minimum Payment of the balance which was due for payment at previous Billing Cycle and is unpaid and still due.
    • Payment Due Date means the date specified in the Statement of Account by when any payments must be made.
    • Payment holiday means the privilege for the Cardholder, at the discretion of the Bank, not to make payment against the outstanding balance of the Card Account for a defined period. Where such a facility is granted, interest will continue to accrue on the balance outstanding on the Card Account.
    • PIN means Personal Identification Number provided by the Bank to the Cardholder for the use with the Card.
    • Promotional Rates means a preferential rate of Interest or any other preferential terms in comparison with the standard terms applying to this product.
    • Security means any cheque, pledge and/or cash deposit retained by the Bank as security for any monies provided to the Cardholder through the Card.
    • Supplementary Card means a supplemental credit card issued to the Supplementary Cardholder
    • Supplementary Cardholder means the person nominated by the Cardholder to use a Supplementary Card.
    • Transaction Datemeans the date specified in the Statement of Account on which the transaction took place.
  • the card

    • The Bank, may at any time and in its sole discretion, require the Principal Cardholder to deposit Security in favour of the Bank for an amount to be determined by the Bank. The Bank shall retain the Security until the Outstanding Balance has been paid. In the event the Principal Cardholder refuses to provide any Security that is demanded by the Bank, the Bank shall have the right to cancel the Card and suspend the Card Services and the Card Account.
    • In the event that the Card Services are terminated, whether by the Cardholder or the Bank, the Bank shall retain this Security for a period of not less than forty-five (45) days from the date of termination, notwithstanding where the Outstanding Balance has been paid.
    • The Principal Cardholder represents and warrants to maintain an account with the Bank for the entire duration that the Card Services are provided to the Cardholder.
    • The Bank reserves the right to terminate, cancel, suspend and/or reject reissuance, renewal or replacement of the Card or the Card Services at any time without notice to the Cardholder.
    • Upon issuance of the Card, the Bank reserves the right to charge the Cardholder the annual membership fee for the issuance of the card. Thereafter, this charge may be applied annually on the anniversary of the account opening.
    • Where a Card is replaced, for whatever reason, prior to the expiry of the Cardholder’s current Card, the Bank may charge the Cardholder a replacement fee at a rate determined from time to time by the Bank.
    • The Card shall at all times remain the property of the Bank and should be returned to the Bank or its duly authorised agent, upon demand, whether verbal or in writing.
    • The Bank retains the right to offer the Cardholder a different interest rate, or other terms to those which the Cardholder originally requested.
    • The Card shall be non-transferable, non-pledgeable, and shall be used only by the person whose name is embossed on the Card.
    • The Bank retains the right to solely determine the Credit Limit provided to the Cardholder from time to time.
    • The Bank reserves the right to change the Card design at any time without prior notice.
  • receipt and usage of the card

    • The Cardholder may collect the Card in person at the branch of the Bank through which he applied, or the Card may be sent by post /courier, at the Cardholder’s risk, to the address mentioned on the application, or to any other address provided by the Cardholder. Upon receiving the Card, the Cardholder undertakes to immediately sign the Card on the designated area.
    • With the exception of the Balance Transfer, the Cardholder may use the Card, Card Account or credit card cheques (where issued) to enter into Card Transactions and avail the Card Services. A Balance Transfer may only be made by the Principal Cardholder.
    • The total sum utilised on the Card Account, inclusive of interest and all other fees and charges may not exceed the Credit Limit. If the Credit Limit is exceeded the Principal Cardholder must immediately pay to the Bank an amount which once received and posted will bring the Outstanding Balance below the Credit Limit.
    • The Cardholder is fully aware that issuance of the Card constitutes a borrowing relationship with the Bank and the Cardholder agrees to repay the Outstanding Balance, subject to the terms and conditions of this Agreement.
    • The Cardholder undertakes to
      • exercise due care in respect of the Card;
      • ensure that the Card is not altered or tampered with in any shape or form;
      • ensure that the Card is not used by anyone other than the Cardholder; and
      • take reasonable precautions to ensure that the Card is not lost, stolen, misused, misplaced or is at any other risk.
    • The Cardholder shall be liable for any damage, harm, losses, costs, charges, interest or any consequence for the breach of any of the above conditions.
    • The amount of Cash Advance available against the card shall be a portion of the Credit Limit as determined by the Bank from time to time.
    • The Principal Cardholder hereby authorises the Bank to enforce any Security against the Outstanding Amount or any part thereof.
    • The Bank shall bear no responsibility/liability towards the Cardholder for any loss or damage to the Cardholder arising as a result of any disruption or failure or defect in any ATM, electronic device, communication system, facilities, data processing system, transaction link, or any industrial or other dispute or anything or whether beyond the control of the Bank or otherwise. That prevents the Cardholder from completing a Card Transaction.
    • The Bank shall not be responsible for any non-acceptance of the Card for any reason whatsoever by a merchant, ATM or branch, or unit. Additionally, the Bank will not be liable for any merchant surcharge.
    • The Card must not be used for any unlawful purpose, including the purchase of goods or services, prohibited by local laws applicable in the Card holder’s or Bank’s jurisdiction.
    • The Cardholder will prevent the PIN from becoming known to any person, other than the person named on each Card, in order to prevent misuse. The Cardholder will not disclose the Card number to any third party except for the purpose of a Card Transaction (or) when reporting the actual loss (or) theft of the Card.
    • If the Card and/or PIN is lost, stolen or for any other reason liable to misuse or the PIN is disclosed in breach of conditions, the Cardholder must immediately notify the Bank’s Cardholder Care Centre at P.O.Box 28000, Doha, Qatar (Tel 494 0000) followed by written notification within 7 days. A police report must be included for the stolen card Cards before a replacement Card is issued. The Cardholder must give the Bank all information in the Cardholder’s possession as to steps deemed by the Bank to assist in the recovery of the missing Card.
    • If the Cardholder recovers a card previously reported as lost or stolen, the Card must not be used, but cut in half and return to the Bank’s Card Centre.
  • the cardholder

    • In the event that there is an Outstanding Balance, the Bank will issue, on any working day, a monthly Statement of Account to the Cardholder at the address provided herein or as updated by the Cardholder. Any and all payments shall be due by the date stated in the monthly Statement of Account.
    • The minimum monthly payment is an amount equal to 5% of the Outstanding Balance or 10 Qatari Riyals, whichever is greater.
    • The Bank reserves the right to debit the Outstanding Balance or any part thereof in addition to, without limitation, any subscriptions, renewal fees, losses and liabilities incurred by the Bank from the use of the Card, from the Cardholder’s Account or any other account maintained by the Cardholder.
    • The Cardholder agrees to check the accuracy of the Statement of Account and shall raise any queries in relation thereto as soon as possible and in any case within thirty (30) days from the issuance of the Statement of Account.
    • The Bank shall be entitled to instigate criminal proceedings against the Cardholder in the event that the Cardholder fails to settle the Outstanding Balance upon the Bank’s demand or for any other breach of conditions set forth herein
    • The Outstanding Balance shall become immediately payable upon:
      • the bankruptcy of the Cardholder;
      • the death of the Cardholder;
      • the demand of the Bank in writing; or
      • the breach by the Cardholder of the terms and conditions of this agreement.
    • The Bank reserves the right to immediately debit the Outstanding Balance or any part thereof from the Cardholder’s Account, if the Cardholder exceeds the Card Credit Limit granted by the Bank.
  • payments & charges

    • All Payments shall be made to the Bank in Qatari Riyals and the Bank reserves the right to refuse any payments made in any other currency.
    • The Principal Cardholder may pay an amount higher than the Minimum Payment shown on the Statement of Account.
    • The Principal Cardholder may, at the Bank’s discretion, pay more than the Outstanding Balance provided on the Statement of Account. Where this occurs, the Bank may permit no Minimum Payment to be made for up to three (3) months provided that the Card Account remains within the allocated Credit Limit. Interest will continue to accrue during this period.
    • The Bank may, at its discretion, allow the Principal Cardholder to take advantage of a Payment Holiday. Such Payment Holiday must be agreed in advance to prevent fees accruing. Interest will continue to accrue in the event of a Payment holiday being approved.
    • With the exception of Cash Advances, where the Grace Period has lapsed, Interest on any unpaid part of the Billed Amount shall accrue from the date of transaction until the Billed Amount has been paid in full to the Bank. No interest will be payable if the Cardholder pays the entire Billed Amount by its Payment Due Date.
    • In addition to the Billed Amount, Cash Advances shall be noted on the Statement of Account separately and shall not be subject to the Grace Period. Interest on any Cash Advances shall be charged from when the Cardholder avails such a facility.
    • The Bank’s standard rates of interest at the time of publication of this agreement are:

      Classic Card

      • 2.1% per month for standard purchases; and
      • 2.5% per month for Cash Advances.

      Platinum Card

      • 1.9% per month for standard purchases; and
      • 2.2% per month for Cash Advances.
    • The Bank reserves the right to change the Bank’s standard rates at any time without prior notice to the Cardholder.
    • Where the Bank applies a Promotional Rate on a specified part of the Card Transactions, interest will be charged on such part at a Promotional Rate, subject to the terms and conditions of the Promotional Rate.
    • Where the Principal Cardholder fails to make the Minimum Payment on or before the Payment Due Date, Late Payment Fee, as specified by the Bank from time to time, shall be levied on the Card Account.
    • Where the Cardholder exceeds the Credit Limit, Over Limit Fees, as specified by the Bank from time to time, shall be charged.
    • For the replacement and re-issuance of cards, a card replacement or re-issuance fee (as applicable) may be levied.
    • Where the card is used for a Cash Advance a Cash Advance Fee of 4.75% of the Cash Advance will be applied with a minimum value of 15 Qatari Riyals.
    • Where the Card is used for transactions in a currency other than Qatari Riyals a fee of 2.75% of the transaction value shall be applied. The amount of any Card Transaction in a currency other than Qatari Riyals will be converted at a rate of exchange determined by Visa/MasterCard International and/or the Bank.
    • Where a Balance Transfer is availed, a fee shall be applied at a rate determined by the Bank from time to time.
    • The above tariff of charges shall be debited by the Bank at the current rate and are subject to change at the Bank’s discretion and without prior notice to the Cardholder.
  • terminations & cancellations

    • The Cardholder may terminate this Agreement by providing the Bank a notice in writing accompanied by all the Card(s).
    • Until and unless such termination occurs, the Bank will re-issue Cards from time-to-time, at its discretion, for use in accordance with this Agreement and the fees for renewed Cards will be automatically debited to the Card Account.
    • The Bank may, at any time and without notice, cancel or suspend the right to use the Card entirely or in respect of specific facilities or refuse to re-issue a new or replacement Card without in any way affecting the Cardholder's obligations under this Agreement, the Bank incurs no liability, due to such revocation (or) notifications, to MasterCard International or Visa Inc and/or related organizations and corporations
  • refund and claims

    • The Cardholder's Account will only be credited with a refund in respect of a Card Transaction if the Bank receives a refund voucher or other refund verification acceptable to the Bank.
    • In case of any dispute regarding any transaction, fees or financial charges, the Cardholder shall inform the Bank, in writing, within fifteen (15) days of the issuance of the Statement of Account, otherwise, all the transactions, fees or financial charges as indicated will be considered as correct and no claims will be entertained thereafter.
  • supplementary cards

    • The Bank may, upon application of the Principal Cardholder, issue Supplementary Card(s). The Principal Cardholder agrees to be liable for all the Card Transactions, charges and fees arising from the use of the Supplementary Card, whether incurred with the Principal Cardholder’s direct knowledge or not, as if Card Transactions, charges and fees incurred on the Supplementary Card were incurred on the Principal Cardholder's Card.
  • general

    • The Cardholder agrees to be liable for all losses incurred for breach of the terms and conditions contained herein or where the Cardholder has failed to take reasonable care or acted in fraudulent manner.
    • The Principal Cardholder shall be solely liable for any losses, expenses, costs, penalties, charges, Interest and for the breach of the conditions contained herein.
    • The Cardholder indemnifies the Bank, its officers, agents, employees and affiliates from and against all actions, claims, proceedings, demands, losses, damages, costs, expenses, charges, taxes, penalties and legal costs and any other liabilities whatsoever which may be suffered or sustained for the breach of the terms and conditions governing the use of the Card or any fraudulent or negligent act or omission of the Cardholder.
    • The Bank shall not be liable for any failure to fulfill its obligations except where such failure is attributable to the willful misconduct on part of the Bank.
    • The Bank shall not be liable for any direct, indirect or consequential loss or damage suffered by the Cardholder as a result of any malfunction, failure or incorrect operation and use of the Card.
    • In addition to any rights contained herein, the Bank reserves the right to, without prior notice to the Cardholder, combine or consolidate all or any amounts, whether in the Qatari currency or not, held in any other account by the Bank in favour of the Cardholder, whether jointly or singly, against the entire Outstanding Balance should the Cardholder fail to maintain, at the to the satisfaction of the Bank, payments in accordance with the terms of this Agreement.
    • The Cardholder undertakes not to abuse the Card, as the abuse of the Card, in some cases, may constitute a misdemeanor penalised by law.
    • The Cardholder shall immediately notify the Bank’s Card Centre, in writing, of any change of Name, Address and/or Employment.
    • The Bank shall not be liable if it is unable to perform its obligations under this Agreement due (directly or indirectly) to the failure of any machine, data processing system, transmission link, industrial dispute or anything outside the control of the Bank or its agents.
    • The Bank may at any time disclose and share with its agents, information with regard to the Card Account, the use of the Card and the Cardholder’s financial affairs.
    • The Bank may amend the terms of this Agreement at any time without notification to the Cardholder and such amendments shall be binding on the Cardholder.
    • The terms of the Agreement shall be governed by and construed in accordance with the laws of the State of Qatar and the Courts of the State of Qatar shall have the exclusive jurisdiction to hear all disputes arising under the Agreement.
    • Where the Bank has issued documents in English and Arabic, in case of differing interpretations, the Arabic text will be construed to be the accurate version.
    • Any delay in enforcing the Bank’s rights under this agreement shall not affect the Bank’s rights.
    • In case the Statement of Account is not received by the Cardholder within Ten (10) days from its issuance, the Cardholder is requested to contact the Bank's Call Centre (Tel 494 0000). Receipt of the Statement of Account is not a precondition for making payment by the Payment Due Date.
    • Unless the outstanding balance is paid in full, the Bank will allocate payments made in the following order:
      • Fees, Charges, Expenses.
      • Interest.
      • Optional Insurance Cover.
      • Card Services.
    • The balances in each category will be repaid according to the interest rate that relates to them:
      • First , any promotional transactions and where payment will be allocated to balances that attract the lowest rate of interest first.
      • Then standard rates where payments will be allocated to balance transfers, then purchases, then Cash Advances.
